Welcome to Connections+ Culture (the “Site”). This website is owned and operated by Soul Canvas Art Studio and Karya Kisahku Ventura Ptd Ltd, hereinafter referred to as “we,” “us,” or “our.”
By accessing or using our Site, or purchasing any artwork, you (“the Customer,” “you,” or “your”) agree to be legally bound by these Terms of Service, which incorporate our Terms of Use (governing site navigation and browsing) and our Terms of Sale (governing transactions). If you do not agree to these terms, please do not use our Site or complete a purchase.
PART A: TERMS OF WEBSITE USE
1. Intellectual Property & Digital Assets
Copyright Ownership:All content on this Site—including but not limited to text, graphics, brand logos, website layout, button icons, digital downloads, and all digital images representing physical or digital artworks—is the exclusive intellectual property of Connections+ Culture and/or the respective artists. It is protected under the Singapore Copyright Act 2021 and international copyright treaties.
Prohibited Digital Actions: You are strictly prohibited from downloading, scraping, framing, copying, distributing, republishing, or creating derivative works of any images or text found on this Site without our explicit, prior written consent.
AI Training Restriction: You are strictly prohibited from using, downloading, or harvesting any images, text, or metadata from this Site for the purpose of training, developing, or testing machine learning, artificial intelligence (AI), or generative image/text models without an explicit, separate written license agreement.
2. Platform Misuse & Site Access
Site Disruption: You agree not to use any automated system (including bots, crawlers, or scrapers) to access, monitor, or disrupt the Site, or attempt to compromise the security, source code, or hosting infrastructure of our platform.
Unauthorized Activities: You must not transmit any worms, viruses, or any code of a destructive nature. Any attempt to gain unauthorized access to our web server or backend payment systems will result in immediate termination of your access and potential legal referral to local authorities.
PART B: TERMS OF SALE (The Transaction Contract)
3. Contract Formation & Order Acceptance
Offer and Acceptance:Displaying artwork on our website constitutes an “invitation to treat.” Your checkout submission is an offer to purchase. A legally binding sales contract is only established when you receive an explicit Order Confirmation Email from us and your payment is successfully processed.
Right of Refusal: We reserve the ultimate right to cancel or refuse any order at our discretion. Reasons for cancellation may include (but are not limited to) artwork being sold out, errors in description or listing price, system glitches, or flags raised by our security systems indicating potential payment fraud. In such cases, we will immediately issue a full refund to your original payment method.
4. Artwork Descriptions, Colors, and Dimensions
Screen Display Disclaimer:You acknowledge that physical artwork is highly subjective and visually unique. While we make every professional effort to capture and display colors, details, and textures accurately, we cannot guarantee that your device’s screen calibration, brightness, or color profiles will perfectly match the physical colors of the artwork delivered. Small tonal variations do not qualify as “defective goods.”
Natural Medium Variations: For original paintings, handmade prints, or mixed-media works, you accept that slight organic imperfections, natural texture variations, and framing irregularities are an inherent part of handmade art and do not constitute defects.
Pricing Corrections: In the unlikely event that an artwork is listed with an incorrect price due to a system or administrative error, we reserve the right to decline or cancel any orders placed for that item, even if the order was confirmed and paid for. We will refund the transaction in full.
5. Prices, Taxes, and Custom Duties
Currency: All transactions and prices are processed and displayed in Singapore Dollars (SGD) unless explicitly configured otherwise by our currency selector.
GST (Goods & Services Tax): We are not currently registered for GST in Singapore, and therefore no GST is charged on our items.
International Customs & Import Taxes:For orders shipped outside of Singapore, you (the buyer) are designated as the “Importer of Record.” You are solely responsible for paying any and all import duties, VAT, customs clearance fees, and regional taxes imposed by your country’s customs agency. We have no control over these fees, nor can we predict their values.
6. Payments
Accepted Methods: We accept payment via credit/debit cards (Visa, Mastercard, AMEX) and PayNow.
Payment Authorization: By submitting payment information, you warrant that you are authorized to use the chosen payment method and authorize us to charge the full transaction amount, including delivery fees.
PART C: LOGISTICS, RISK TRANSFER & RETURNS
7. Shipping, Delivery, and Risk Transfer
Delivery Notification & Scheduling: If you choose the delivery option at checkout, we will personally contact you (via the email address or phone number provided during checkout) to inform you of the delivery schedule and coordinate the logistics. Custom arrangements regarding the specific dates and times of delivery can be discussed and mutually agreed upon during this personal coordination.
Estimated Deliveries: Any general delivery timelines displayed on the Site are estimates only. We are not legally liable for delayed arrivals caused by courier disruptions, custom clearances, bad weather, or regional transit delays.
Transfer of Risk and Title: For local Singapore deliveries, legal ownership (title) and the risk of loss, damage, or theft of the physical artwork pass to you (the buyer) upon successful delivery to your specified address. For international shipments, risk and title pass to you the moment the packaged artwork is handed over to our designated international courier service.
Insurance: High-value shipments will be shipped with a tracked, signed-for courier. If you require additional bespoke transit insurance, please contact us before placing your order.
8. Strict Damage Claim Protocol
Because art is fragile, any claims for damage must adhere strictly to the following process to ensure we can resolve the issue with our logistics insurers:
48-Hour Notification WindowYou must inspect the artwork immediately upon arrival. If the artwork arrives damaged, you must email our support team at [email protected] within 48 hours of delivery.
Mandatory Photographic EvidenceYour email must contain:• Clear photographs of the external packaging, focusing on any dents, punctures, or tears.
• Clear photographs of the internal cushioning and protection materials.
• Clear, high-resolution photographs of the damage to the actual physical artwork.
Late ClaimsFailure to contact us with the required photographic evidence within the 48-hour delivery window will invalidate any potential claim for replacement, repair, or refund.
9. Return and Refund Policy
To preserve the value of original creations, our refund policy is strictly segmented:
Original Artworks & Commissioned PiecesAll sales of original canvases, unique sculptures, and custom/commissioned artwork are strictly final and non-refundable, except in cases of proven damage sustained during transit (subject to Section 8).
Open-Edition PrintsFor standard open-edition paper prints, you may request an exchange or refund within 14 days of delivery. The following rules apply:• The print must be returned in its original, undamaged packaging, in an unused and pristine condition.
• The customer is solely responsible for paying all return shipping, packaging, and tracking costs.
• We highly recommend using a tracked, insured return service. If the returned print is damaged during its journey back to us, we will be unable to issue a refund.
PART D: LEGAL PROTECTION & LIABILITY
10. The Golden Rule of Art Ownership (Copyright Retention)
No Transfer of IP: When you purchase an artwork (whether an original physical piece or a limited-edition print), you are purchasing the physical medium only.
No Commercial Exploitation: The Copyright remains entirely and exclusively with the artist. You may not scan, digitize, replicate, sell digital prints of, license, or use the artwork for any commercial purpose (e.g., brand marketing, merchandise, book covers) without entering into a separate, written Licensing Agreement with the artist or their legal representative.
11. Limitation of Liability
To the maximum extent permitted by the laws of Singapore, Connections+ Culture shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of potential profits, loss of data, loss of goodwill, emotional distress, or damage to property arising out of your use of our platform or purchase of any goods.
In all circumstances, our maximum aggregate liability to you for any claim arising from these Terms or the purchase of any artwork is strictly capped at the exact dollar amount paid by you to us for that specific transaction.
12. Governing Law & Dispute Resolution
Governing Law: These Terms, and all relations and contracts formed hereunder, shall be governed, interpreted, and construed in accordance with the laws of the Republic of Singapore.
Escalation Path: In the event of any dispute, disagreement, or claim arising out of your transaction or your interaction with this Site, both parties agree to first seek an amicable, informal resolution via written correspondence.
Mediation & Litigation: If the dispute cannot be resolved informally within thirty (30) days, both parties agree to explore resolving the matter through mediation at the Singapore Mediation Centre (SMC) before resorting to litigation. Any unresolved legal disputes shall be submitted to the exclusive jurisdiction of the courts of Singapore.
